These Terms and Conditions (“Terms”) govern your access to and use of our website and your purchase of products through it. By browsing our site or placing an order, you agree to these Terms. 1. About Us

Eurotoys.shop is operated by European Jalopies LLC dba Eurotoys, a Minnesota limited liability company based in Minneapolis, Minnesota, specializing in European and imported model trains and collectibles, including but not limited to Märklin, Roco, Fleischmann, LGB, Trix, and Viessmann products, in both new and pre-owned/vintage condition.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order on this site. By placing an order, you represent that you meet this requirement and that all information you provide is accurate and complete.

3. Products, Descriptions, and Condition

• Vintage/used inventory: Many items sold on this site are vintage, used, or collector-grade model trains and related items. Unless explicitly described as “new,” “NIB” (new in box), or “NOS” (new-old stock), all items are sold in used or pre-owned condition and may show signs of age, prior ownership, or handling.
• Descriptions: We make reasonable efforts to describe and photograph each item accurately, including condition (e.g., mint, excellent, good, fair), known defects, missing parts, or repairs. However, minor variations between photographs, descriptions, and the physical item may occur, particularly for vintage pieces.
• Servicing: Where applicable, we note whether an item has been serviced, restored, or modified (e.g., decoder installation, lighting conversion, motor or magnet replacement).
• Authenticity: We take reasonable care to accurately attribute brand, era, and production details based on our expertise and available reference sources. We do not provide formal third-party authentication or appraisal certificates unless specifically stated in a listing.

All items are sold “as-is” and “as described” except where a specific warranty is stated in the listing.

4. Pricing and Payment

• All prices are listed in U.S. Dollars unless otherwise noted.
• We reserve the right to correct pricing errors at any time before an order is confirmed. If a pricing error is discovered after an order is placed, we will contact you to confirm the correct price or cancel the order with a full refund.
• Applicable sales tax will be calculated and collected at checkout for jurisdictions where we are required to collect it.
• Payment is due in full at the time of order. We accept the payment methods displayed at checkout.

5. Order Acceptance

Receipt of an order confirmation does not constitute our acceptance of an order. We reserve the right to limit, refuse, or cancel any order, including after payment has been processed, for reasons including but not limited to: suspected fraud, pricing errors, inventory errors (including items sold at trade shows or through other channels before online inventory is updated), or inability to verify shipping information. If we cancel an order, you will receive a full refund of any amount charged.

6. Shipping

• We ship within the United States and, where noted, internationally.
• Shipping costs, methods, and estimated delivery times are provided at checkout and are estimates only; we are not responsible for carrier delays.
• Risk of loss and title for items pass to you upon our delivery to the carrier.
• International customers are responsible for any customs duties, import taxes, tariffs, or fees imposed by their country. These charges are not included in the item price or shipping cost and are the buyer’s responsibility.
• Please inspect packages promptly upon arrival. Damage claims for items damaged in transit must be reported to us within 5 business days of delivery, with photos of the damaged item and packaging, so we can file a claim with the carrier.

7. Returns, Refunds, and Cancellations

Given the vintage and often one-of-a-kind nature of much of our inventory, all sales are generally final except as described below.

• If an item arrives materially different from its description (e.g., undisclosed damage or missing functionality specifically warranted in the listing), contact us within 5 business days of delivery to arrange a return, replacement, or refund at our discretion.
• Items must be returned in the same condition as received, in original packaging.
• Buyer is responsible for return shipping costs unless the return is due to our error or a significant undisclosed defect.
• Refunds are issued to the original payment method within 10 business days after we receive and inspect the returned item.
• Custom orders, made-to-order conversions, or specially sourced items may be marked non-returnable in the listing.

8. Warranties and Disclaimers

• Except as expressly stated in an individual listing, all products are provided “AS IS” without warranty of any kind, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.
• We do not warrant that operational/electrical items (locomotives, vehicles, decoders, lighting, etc.) will remain functional indefinitely or are free from the ordinary wear expected of vintage electronics and mechanisms.
• Nothing in these Terms affects any non-waivable statutory rights you may have under applicable consumer protection law.

9. Limitation of Liability

To the fullest extent permitted by law, Eurotoys and European Jalopies LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the site or purchase of products, including but not limited to loss of collection value, lost profits, or data loss. Our total liability for any claim arising from a purchase shall not exceed the amount you paid for the item giving rise to the claim.

10. Intellectual Property

All content on this site — including text, images, logos, and photographs of inventory — is the property of European Jalopies LLC or its licensors and may not be reproduced, distributed, or used without our prior written permission. Product names, brand names, and trademarks (e.g., Märklin®, Roco®, Fleischmann®, LGB®, Viessmann®) belong to their respective owners and are used for identification purposes only; Eurotoys is an independent reseller and is not affiliated with or endorsed by these manufacturers unless otherwise stated.

11. User Conduct

You agree not to use the site to: violate any law; infringe on intellectual property rights; transmit harmful code; attempt unauthorized access to our systems; or engage in fraudulent transactions.

12. Privacy

Our collection and use of your personal information is governed by our Privacy Policy, available on our site. By using this site, you consent to that collection and use.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the site shall be resolved in the state or federal courts located in Hennepin County, Minnesota, and you consent to personal jurisdiction there.
